1. Acceptance of Terms

By accessing or using the On Me OS guest or boarding portal, creating a House Account, or establishing tabs, you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the platform.

You must be at least 21 years of age to purchase or consume alcoholic beverages at our venues. By opening a tab that includes alcoholic beverages, you verify that you are of legal drinking age.

2. SMS Program Rules & Disclosures

To provide you with secure entry, tab updates, and real-time host notifications, On Me OS operates an automated SMS program.

Program Description: Program messages include secure One-Time Passcodes (OTP) for authentication, notifications of funded wallet funds, real-time receipt delivery, tab management updates, and staff alerts.
Message Frequency: Messaging frequency is transactional and varies based on your usage. Standard account access and tab operations trigger 2 to 6 messages per visit.
Rates: Message and data rates may apply. Check with your mobile carrier for your specific plan's text messaging rates.
Support: If you experience issues with the messaging program or need help, reply HELP to our code, or email support@onme.nyc.
Carrier Support: Mobile carriers (including T-Mobile, AT&T, Verizon, and others) are not liable for delayed or undelivered messages.

HOW TO OPT OUT

How to Opt Out: You may cancel the SMS service at any time by replying STOP to any automated alert we send. Upon receiving your command, the system will deliver one final transactional confirmation SMS verifying your unsubscribed status. Following this, you will no longer receive SMS messages from On Me OS for that specific tab or venue loop unless you explicitly opt back in by texting START or JOIN.

3. House Accounts & Wallet Funding

To purchase food, drinks, and other hospitality items, you may fund a House Account. When funding a House Account with our standard preset amounts or a custom amount:

Loaded funds are converted into venue credit which resides on your active profile.
Promotional incentives (e.g., "First Drink on Us" or bonus credits) are subject to the specific eligibility rules defined at checkout.
Credits are non-transferable and can only be redeemed for goods and services at participating venue locations.

3.1 PLATFORM COMMUNICATIONS

By maintaining an active digital wallet, House Account, or profile with On Me OS, you authorize the Platform to deliver system updates, venue onboarding announcements, and transactional or promotional alerts. All users reserve the right to free-turn these communication modes inside their Account Preferences or terminate SMS delivery via standard stop commands.

4. Tab Operations & Charge Authorizations

By opening a tab, you authorize On Me OS to charge your selected payment method (including Apple Pay, Google Pay, or card on file) for all incurred menu items, applicable taxes, and a standard default service fee (tip) of up to 20%.

All tabs must be closed at the end of the evening. Unclosed tabs will be closed automatically by our systems at venue closing time and will be subject to the standard service fee.

5. Prohibited Conduct

You agree not to bypass security, interfere with payment transactions, simulate access credentials, or use our hospitality engine for any fraudulent activities. We reserve the right to suspend or terminate your House Account and venue access at any time, without prior notice, if we suspect a violation of these Terms.

6. Limitation of Liability

The platform and all services are provided "as is" and "as available". We make no warranties, expressed or implied, regarding the platform's continuous uptime or instant carrier SMS delivery. Under no circumstances shall we be liable for any direct, indirect, incidental, or consequential damages resulting from your use of the platform.

7. Amendments

We reserve the right to modify these Terms at any time. We will indicate revisions by updating the "Last Updated" date at the top of this document. Continued use of our portal after changes are posted constitutes your acceptance of the updated Terms.
